1. Introduction

Welcome to the DroneOps Platform (the "App"). By accessing or using this App, you agree to comply with these Terms of Use ("Terms"). If you do not agree to these Terms, you must discontinue using the App immediately.

This App is developed by an individual and is not affiliated with any juridical entity or business. It is an independent informational tool created to help drone pilots in Romania plan flights, visualise airspace restrictions and generate documentation (such as Annex 1 / Annex 2 PDFs).

The App is not an official system of any authority (including but not limited to ROMATSA, AACR, MApN or any other state institution), does not issue flight approvals and does not replace any official procedure, portal or communication channel of those authorities.

Important: Use of this App does not replace the user's obligation to follow all applicable national and international laws and regulations, as outlined in Section 3.2.

2. Eligibility

  • You must be at least 16 years old to use the App.
  • For certain drone operations under specific rules, no minimum age may apply as per European and national regulations.

3. User Responsibilities

3.1 General Conduct

You are solely responsible for your actions within the App. Prohibited activities include, but are not limited to:

  • Violating airspace laws or restrictions.
  • Submitting false or misleading flight plans or information.
  • Breaching data protection regulations.
3.2 Compliance with Regulations

Users must comply with all relevant regulations, including but not limited to:

  1. Regulation (EU) 2018/1139 - Common rules in the field of civil aviation.
  2. Commission Delegated Regulation (EU) 2019/945 on unmanned aircraft systems.
  3. Commission Implementing Regulation (EU) 2019/947 on the operation of unmanned aircraft.
  4. Regulation (EC) No 785/2004 on insurance requirements for air carriers and operators.
  5. Law No. 21/2020 - Romanian Air Code.
  6. Romanian Government Decision No. 912/2010 for authorizing flights in national airspace.
  7. Romanian Government Decision No. 859/2021 for authorizing aircraft flights.
  8. Romanian Government Decision No. 643/2020 on implementing Commission Delegated Regulation (EU) 2019/945 and Implementing Regulation (EU) 2019/947.

Note: The App itself does not grant any operational approval, clearance or authorisation. Any approval, acceptance or conditions you may receive are issued exclusively by the competent authorities (such as ATC units, AACR, MApN or other institutions), based on the emails, forms and annexes that you send to them using their official channels (typically email or dedicated portals). You are responsible for obtaining all required approvals and for complying with their conditions.

3.3 Flight Documentation and Approvals

The App is designed to assist you in planning and documenting flights (e.g., showing restrictions on a map, generating Annex 1 / Annex 2 PDFs and providing tools to sign and share these documents). It does not make any operational decision on whether you may or may not fly.

  • You must not conduct any flight that would violate applicable laws, regulations or published restrictions, even if a mission is created or appears as "submitted" or "saved" in the App.
  • The App does not provide any separation between drones and other aircraft and does not provide air traffic control services. Pilots are solely responsible for maintaining safe separation and complying with VLOS/BVLOS and other operational requirements.
  • The App may indicate that your planned area intersects certain zones (e.g. CTR or UAS geographical zones) and may help you prepare documentation, but this information is provided for guidance only and may not be complete or error-free. You must always verify the current status of the airspace using official sources.
  • For any zone or procedure that requires notification, approval or coordination (for example, operations in CTR, military areas or special use airspace), you are responsible for using the appropriate official channels to request and obtain approval (e.g. sending Annex 1 / 2 PDFs by email to ATC, using aerofoto.mapn.ro or other published contacts).
  • The App does not guarantee that authorities will approve a flight, respond within a certain time, or accept a particular format of documentation.

4. Account Management

4.1 Account Creation
  • Users must provide accurate and complete information during registration.
  • A valid phone number is required and should remain active during any planned or ongoing operation, in case authorities need to contact you.
4.2 Account Termination
  • Users can request account termination at any time via the App or by contacting the developer.
  • Repeated violations of these Terms or misuse of the App may result in account suspension or termination.

5. Limitation of Liability

  • The developer is not responsible for accidents, incidents, infringements, delays, rejections, or any direct or indirect damages arising from use of the App, from flight operations, or from any decision taken based on information or documentation generated by the App.
  • The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, fitness for a particular purpose or non-infringement.
  • The user remains fully responsible for verifying airspace information through official sources and for obtaining all necessary approvals from competent authorities.

6. Privacy

User data is handled in accordance with the Privacy Policy and GDPR.

7. Intellectual Property

All content, trademarks, and data on this App, including but not limited to software, databases, text, graphics, icons, hyperlinks, private information, designs, and agreements, are the property of the developer or have been licensed to the developer and as such are protected from infringement by local and international legislation and treaties.

8. User-Generated Content

Users may submit content to the App, including but not limited to flight plans and comments. By submitting content, users grant the developer a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media, solely for purposes related to operating and improving the App.

Users are solely responsible for the content they submit and must ensure that it does not violate any laws or infringe on the rights of third parties. The developer reserves the right (but has no obligation) to remove content that is unlawful, abusive or inappropriate.

9. Prohibited Uses

In addition to the general conduct rules, users are prohibited from:

  • Using the App for any unlawful purpose or to facilitate unlawful activities.
  • Attempting to gain unauthorized access to the App or its related systems or networks.
  • Interfering with or disrupting the security, integrity or performance of the App.
  • Using the App to transmit any harmful or malicious code (including viruses, worms, or malware).

10. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Romania. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Romania.

12. Changes to Terms

The developer may update these Terms from time to time, for example to reflect changes in law or in the functionality of the App. Users will be notified via email or via an in-app notice of material updates. Continued use of the App after such updates constitutes acceptance of the revised Terms.
